Catherine Linares found four videos on her husband's cell phone the day Linares was arrested. The videos included lengthy close-ups of the clothed buttocks and crotch. Alyssa is seen in jean shorts while she watches television. Linares zooms in and outside and focuses on her crotch. In the second video, she's playing with her younger brother.
The OCSD school resource officer collected information from students regarding the alleged assaults and sent it to sex crime investigators. The alleged assaults took place on school grounds within the span of a year, according to OCSD, and were perpetrated by Linares. The allegations were reported by a third woman who made her voice heard after hearing news reports. The Orange County Sheriff's Department is investigating all three women's allegations against Linares.
The video recorded by the cell phone showed Alyssa's buttocks getting rubbed by Linares and Linares singing and dancing while she was getting dressed in the bathroom. The footage was played back in court Putas Talca, and witnesses testified about the content of the video. Linares admitted that he had the phone in the bathroom but did not admit to recording Alyssa. Instead Linares deleted the video after realizing Alyssa was in the shower.
In the trial that followed, the jury determined that Linares intented to sexually stimulate viewers in his videos. Although Alyssa had no intention of divulging her rectal and pubic areas to the public, the video showed the opposite. Linares was eventually found guilty. It was a unanimous verdict. Alyssa was not involved in the videos and both were released following the trial.
Alyssa's lawyer at trial claimed that the violation of privacy convictions cannot stand. The court ruled that there was no evidence that Linares concealed his camera when taking photos and videos. The convictions are unconstitutional because Linares didn't meet the law that protects his victims privacy. And in the final decision, the court decided that Linares actions were illegal despite Alyssa's lack of knowledge.
